DISTANCE SALES AGREEMENT CLARIFICATION TEXT UNDER THE LAW NO. 6698 ON THE PROTECTION OF PERSONAL DATA

This clarification text has been prepared by SILVERSTONE LLC as the data controller, in accordance with Article 10 of the Law No. 6698 on the Protection of Personal Data (hereinafter referred to as the “KVKK” or the “Law”), and the Regulation on the Procedure and Principles for Fulfilling the Clarification Obligation, to inform you as a data subject. SILVERSTONE LLC is providing the necessary information and clarification regarding this matter. The details of the data controller, SILVERSTONE LLC (hereinafter referred to as the “Company”), are as follows:

1. WHAT IS PERSONAL DATA?

Personal data is defined in the Law No. 6698 as “any information related to an identified or identifiable natural person.” As understood from the definition, any information that can identify you is considered personal data. Additionally, sensitive personal data includes political opinions, religious beliefs, race, ethnicity, membership in associations or foundations, health information, philosophical views, beliefs, sexual orientation, criminal records, conviction details, and biometric data.

2. PURPOSES OF PROCESSING YOUR PERSONAL DATA

Your personal data is processed within the limits set by the Law No. 6698, based on the principles outlined in the Law. The personal data we process through the distance sales agreement on our website include “name-surname, address, phone number, identification number, email address, and bank account details.” Under the Law, the purposes of processing your personal data as SILVERSTONE LLC are as follows:

• To fully fulfill our services
• To follow up and execute legal matters
• To manage contract processes
• To manage goods and services sales processes
• To provide after-sales support for goods and services
• To manage goods and services purchasing processes
• To carry out communication activities
• To manage finance and accounting operations
• To ensure compliance with regulations in the conduct of activities

3. PRINCIPLES REGARDING THE PROCESSING OF YOUR PERSONAL DATA

As SILVERSTONE LLC, we adhere to the following principles in processing your personal data:

1. To keep the data for the necessary period as stipulated in the relevant legislation or as required by the purpose for which the data is processed,

2. To process the data in accordance with the law,

3. To ensure the data is kept up to date,

4. To act in accordance with the principles of fairness,

5. Not to use the data for purposes other than the ones it was processed for,

6. To process the data in a manner that is adequate and limited to the purpose it was collected for,

7. To process the data in accordance with general morality, customs, and practices,

8. To process the data in compliance with the Law No. 6698 and all other relevant regulations.

9. METHOD OF COLLECTION AND LEGAL BASIS FOR PERSONAL DATA

Your personal data is collected via the distance sales agreement available on our website and processed through automated means.
Your personal data is processed based on the following legal grounds, as per Article 5, paragraph 2 of the Law No. 6698:

• Explicit provision in laws,
• Necessity for the establishment or performance of a contract,
• Necessity for the data controller to fulfill a legal obligation,
• Processing being necessary for the establishment, exercise, or defense of legal claims,
• Processing being necessary for the legitimate interests of the data controller, provided it does not harm the data subject’s fundamental rights and freedoms.

5. RECIPIENTS OF PERSONAL DATA AND PURPOSE OF DATA TRANSFER

Your personal data may be shared with third parties in accordance with the conditions and purposes specified in Articles 8 and 9 of the Law No. 6698, and in compliance with our confidentiality agreements, when necessary. SILVERSTONE LLC ensures compliance with these regulations and takes appropriate technical and administrative measures during data transfers.

In addition, your personal data may be transferred to suppliers located abroad or with servers located abroad, for the purpose of enhancing our service quality and continuity, provided that explicit consent is obtained in accordance with Article 9/1 of the Law No. 6698.

6. RIGHTS OF THE DATA SUBJECT

A- GENERAL INFORMATION ABOUT YOUR RIGHTS AND APPLICATION

Article 11 of the Law No. 6698 grants the data subject certain rights regarding the processing of their personal data. The rights of the data subject, as set out in the Law, are as follows:

1. To learn whether personal data is processed,
2. To request information about personal data if it has been processed,
3. To learn the purpose of processing personal data and whether it is used for its intended purpose,
4. To know third parties, domestically or internationally, to whom personal data has been transferred,
5. To request correction of personal data if it is incomplete or incorrect,
6. To request deletion or destruction of personal data under the conditions specified in Article 7 of the Law on the deletion or destruction of personal data,
7. To request that corrections made to personal data be notified to third parties to whom the data has been transferred,
8. To object to the processing of personal data if it leads to an unfavorable result for the individual, particularly through automated systems,
9. To request compensation for damages caused by unlawful processing of personal data.

B- APPLICATION PROCEDURE

Requests regarding the above-mentioned rights can be submitted in writing or through a registered electronic post (KEP), secure electronic signature, mobile signature, or using the email address previously notified by the data subject and registered in the data controller’s system. To exercise your rights regarding personal data, you can check the information on our website and use the “Personal Data Protection Law Information Request Form” available on our site.

C- REQUIRED INFORMATION FOR APPLICATION

The information that must be included in your application is as follows:

• Your full name
• Your Turkish ID number (if applicable)
• Your nationality, passport number, or ID number if you are a foreign national
• If applying in writing, your signed petition
• The content and subject of your request under Article 11 of the KVKK
• Phone and fax number where you can be reached
• Your email address where you can be contacted
• Your residential address or work address for notifications
